Terms of Service

1. Accounts and eligibility

You must be at least 18 years old and legally able to enter into this agreement. Provide accurate account information, protect your credentials, and use only accounts and workspaces you are authorized to access. You are responsible for activity under your account and for permissions you grant to workspace members.

2. Your content and permissions

You retain the rights you have in content you upload, including product images, logos, text, and brand assets. You grant HeroImage permission to store, process, reproduce, and transmit that content as needed to provide the features you request, including processing by relevant service providers.

You must have the necessary rights and permissions to upload and use content. Do not submit confidential information or personal data unless you are authorized to share it for the requested processing. Workspace sharing and export can make content available to other people.

3. AI-generated content

You may use outputs available to you through the service, subject to these terms, applicable law, and any provider-specific restrictions disclosed for the feature. HeroImage does not claim ownership of your uploads or outputs merely because you use the service.

AI outputs may be inaccurate, incomplete, similar to other outputs, or unsuitable for your intended use. Review images, product details, claims, and other outputs before publishing. You are responsible for checking intellectual-property rights, marketplace rules, advertising requirements, and the accuracy of product representations. We do not guarantee that outputs qualify for copyright protection or are free of third-party rights.

4. Acceptable use

Do not use HeroImage for unlawful, fraudulent, deceptive, abusive, or infringing activity. Do not impersonate people without permission, create misleading product claims, distribute malicious software, attempt unauthorized access, bypass usage limits or payment requirements, or interfere with the service or other users.

Use research and third-party information only in ways permitted by applicable law and the relevant source's terms. Access to a tool does not grant permission to copy another business's protected content or branding.

5. Plans, fees, and credits

Pricing, included features, usage allowances, credit rules, and any renewal or cancellation terms are those disclosed when you select or purchase a plan. Review those details before paying. Taxes may apply where required.

Credits are service usage units, not currency or a financial account. Refund eligibility is governed by the terms disclosed for your purchase and applicable law. These terms do not limit any mandatory consumer rights.

6. Third-party services and availability

HeroImage depends on third-party authentication, hosting, AI, and other services. Features may be unavailable, delayed, or changed because of maintenance, technical issues, provider changes, or security needs. External services may have their own terms and privacy policies.

Keep copies of content you need outside HeroImage. We do not promise uninterrupted access, a particular creative result, or a specific commercial outcome unless separately agreed in writing.

7. Suspension and termination

We may restrict or suspend access when reasonably necessary to address misuse, security risks, unpaid fees, legal requirements, or a material violation of these terms. Where appropriate and lawful, we will provide notice and an opportunity to address the issue.

You can stop using the service and request account deletion by contacting us. Any outstanding obligations and provisions that naturally apply after termination continue to apply. Information handling after deletion is described in our Privacy Policy.

8. Disclaimers and responsibility

To the extent permitted by law, the service is provided on an “as is” and “as available” basis, without warranties of merchantability, fitness for a particular purpose, or non-infringement. You remain responsible for reviewing and deciding how to use outputs.

To the extent permitted by law, HeroImage is not responsible for indirect or consequential losses, including lost profits, arising from use of the service. Nothing in these terms excludes liability or legal rights that cannot lawfully be excluded.

9. Changes to these terms

We may update these terms as the service changes. The date above identifies the latest version. We will provide notice of material changes where required by law. If you do not agree to updated terms, stop using the service.
